Within the City of Newark it is unlawful for the operator or person in charge or control of a motor vehicle to permit the operation of any tape player, music speaker, loudspeaker, or similar device in or on such vehicle in such a manner as to be plainly audible on a public right-of-way or on a public space at 50 feet or more from the vehicle.
The minimum fine for operating a loud radio from a vehicle is $100 for the first offense.
Noise from Residences & Other Buildings
It is likewise unlawful for any person to operate or permit the operation of a radio receiving set, musical instrument, television, phonograph, drum, or other device for the production or reproduction of sound in such a manner as to create a noise disturbance or to be plainly audible across real property boundaries or through such partitions between a building and a public right-of-way between the hours of 9 p.m. and the following 7 a.m.
The minimum fine for creating unlawful noise in this manner is $100 for the first offense.
The conviction of any rental property tenant, who violates the City Noise / Disorderly Premise Ordinance more than one time within a one year period, shall result in the termination of the rental agreement as it applies to all tenants at the rental property.
